Vermont Country Store Lawsuit

The law firm has filed a lawsuit in Federal Court on behalf of employees of The Vermont Country Store, Inc. The lawsuit claims that the employees were not paid minimum wage for all of the hours they worked at the Vermont Country Store.

Who is covered?

The lawsuit was brought on behalf of the named Plaintiff Doreen Forauer and all Telemarketing Sales Representatives and Customer Service Representatives who worked for the Vermont Country Store in the last three years.

How were employees underpaid?

The lawsuit claims that the Vermont Country Store did not pay minimum wages for time the employees spent before and after their shifts doing tasks such as booting up the computers, reading company emails and memoranda, filing mail, and the like. Doreen Forauer has represented to the Court that employees at the call center had to do these types of tasks before clocking in and after clocking out. The lawsuit claims that the Vermont Country Store should have paid employees for this time, but did not.

Will people receive notice of the lawsuit?

The Federal Court has ordered that notice should be sent to all current and former Telemarketing Sales Representatives and Customer Service Representatives employed by The Vermont Country Store within three years prior to July 31, 2013.

Can I join the lawsuit?

If you are a Telemarketing Sales Representative or Customer Service Representative at the Vermont Country Store, or if you worked there in the last three years in one of those roles, you may choose to join the lawsuit.

I worked for the Vermont Country Store in another capacity, and I think I was not paid for all the hours I worked. Can I join the lawsuit?

What happens if I join?

If you choose to join this lawsuit, you will be bound by any ruling, judgment, award or settlement. If you do not join, you will not be bound, and you are free to take action on your own.

Can I be fired if I join?

No. The law prohibits retaliation against you for exercising your rights under the Fair Labor Standards Act ("FLSA"). It is illegal for the Vermont Country Store to retaliate against you in any way because you choose to participate in this lawsuit.

What happens if we are successful?

The lawsuit asks the Court to order the Vermont Country Store to pay employees for all hours worked in the future. It also asks for the Court to order that the company pay the back wages of covered employees, plus "liquidated damages" of an equal amount. It also asks for interest on these amounts. If the lawsuit is successful, either by settlement or by judgment in Court, the employees who have joined the suit will receive some amount of money to compensate them for their unpaid wages.

How will the lawyers be paid?

The attorneys are being paid on a contingency fee and/or statutory basis, which means that if there is no recovery, there will be no attorney's fees. If there is a recovery, the attorneys will receive a part of any settlement obtained or money judgment entered in favor of all members of the class.
